Community Creator Terms

1. Introduction

These Creator Terms apply to those who create and administer communities on WEMANY. They complement the Terms of Service, the Acceptable Use Policy, the Transaction Terms and the WeMatch Policy. By creating a community you accept these Terms and the Data Processing Addendum (Section 13).

2. Your role as a creator

As a creator, you are the seller and the responsible party towards your members for the products, courses, memberships, events and services you offer. WEMANY acts as a technology facilitator and not as a seller. You are responsible for delivering what you promise to your members, for the legality of your content and for your relationship with them.

3. Creator responsibilities

• Active moderation: monitor and moderate your community's content.
• Policy compliance: ensure your community respects WEMANY's policies.
• Member support: handle questions and complaints diligently.
• Clear rules: set and communicate your community's rules.
• Truthful descriptions: accurately describe the purpose, content and benefits.
• Consistent delivery: deliver the promised content, access or service.
• Fair treatment: no discrimination on protected characteristics; resolve disputes professionally.

4. Monetization and payments

• Platform fee: WEMANY retains 10% of each transaction; WEMANY covers the processor's cost out of that fee. You receive the transaction value minus that fee and applicable taxes.
• Custody of funds: funds are held within the payment processor's infrastructure, not in WEMANY's own accounts (see the Transaction Terms).
• Payouts: a 7-day hold per transaction before it becomes available; payouts according to the processor's schedule and the minimum threshold in the Creator Dashboard.
• Transparent pricing and billing: clear prices and cycles; no hidden charges.
• Refund policy: you must set and communicate your refund policy before purchase; it cannot be lower than mandatory consumer rights (withdrawal in Colombia, right of withdrawal in the EU) or the 7-day guarantee on WEMANY courses.
• Taxes: you are responsible for declaring and paying taxes on your income (including VAT or other consumption taxes and income tax where applicable).

Prohibited: misleading prices or hidden charges; attempting to bypass the platform's payment system; chargebacks arising from failing to deliver what was promised; tax evasion.

4.1 Co-producers and collaborators

Co-producers: you can invite other people as co-producers of your community. Co-producers can receive a percentage of the community's earnings, defined by you at the time of the invitation. The relationship between you and the co-producers is independent of WEMANY; you are responsible for your internal agreements with them. At your request, WEMANY can automatically split payouts according to the percentages you define in the Creator Dashboard.

Collaborators: you can invite collaborators to help you administer your community (moderate, publish content, manage members) without sharing your login credentials. Collaborators do not have access to funds or payment features; only to the features you assign them.

Both co-producers and collaborators must have WEMANY accounts in good standing and comply with these Terms and the platform's policies. You are responsible for the actions of your co-producers and collaborators within your community.

5. Data, analytics and gamification

5.1 Permitted use of member data

• Access aggregated analytics on participation.
• Use activity data for gamification (achievements, leaderboards, challenges).
• Analyze behavior to improve your community's experience.
• Access WeMatch validation data only when the member consents.

5.2 Data protection obligations

• Comply with applicable data protection laws (GDPR, CCPA/CPRA, Law 1581 of 2012 in Colombia, among others).
• Obtain appropriate consent for uses beyond the community's basic functionality.
• Implement reasonable security measures.
• Clearly disclose how data will be used for gamification and analytics.

5.3 Prohibited

• Sharing member data with third parties without consent.
• Using data for undisclosed purposes.
• Extracting data for purposes unrelated to managing the community.
• Using one community's data to benefit another without consent.
• Accessing the raw data that feeds WeMatch (you only receive validation results, not the underlying figures).

6. WeMatch

• Use validation data only for legitimate and disclosed purposes of your community.
• Do not discriminate unlawfully on the basis of validation data.
• Offer your members a channel to appeal your community's validation decisions.
• Do not falsify or manipulate validation results.

WeMatch and the Mission Score are operated by WEMANY as controller; you access results with the member's consent, within the limits of the WeMatch Policy.

7. Content and intellectual property

• Your content: you retain ownership of the original content you create.
• License to WEMANY: you grant WEMANY a worldwide, non-exclusive, royalty-free license to host, store, reproduce and display your content on the platform for the purpose of providing the Service (for example, showing your courses to your members). This license ends when you delete the content or close your community, except for residual technical copies or those the law requires us to keep.
• Third-party rights: you warrant that you hold the rights to the content you publish.
• DMCA / copyright: WEMANY responds to valid takedown notices for infringement and maintains a notice and counter-notice process; repeat infringers may be excluded.

8. Moderation and standards

You must review your community's content, handle your members' reports promptly, remove content that violates WEMANY's policies, apply your rules fairly and consistently, and maintain an environment appropriate for your audience.

9. Performance standards

You must maintain reasonable presence and activity, interact with your members, deliver valuable content and make reasonable efforts to develop your community. WEMANY may review community metrics and member feedback to verify policy compliance and service quality.

10. Account management and termination

Initiated by the creator

• You can close your community with reasonable notice to paying members.
• You can delete your account by following the platform's procedure.

Initiated by WEMANY

• We may suspend or terminate for serious or repeated policy violations, for failing to meet minimum standards or for payment issues (for example, excessive chargebacks).

After termination

• Community data is kept or deleted according to our retention policy.
• Refunds may be processed for affected members as appropriate.
• The community's content is removed from the platform.
• You have the right to appeal termination decisions.
• Withholding of funds: after your account is terminated, WEMANY may withhold funds pending payout for up to 180 days to cover possible refunds, chargebacks, disputes, tax obligations or liabilities arising from your activity on the platform. After that period, the remaining funds will be paid out to your registered bank account, unless there are pending claims or proceedings that justify an additional hold.

11. Support

• Creator Dashboard: analytics, payments and management tools.
• Documentation and support: guides and assistance for creators.

12. Changes

We may update these Terms. We will announce significant changes through the Creator Dashboard and by email, with their effective date. Continued operation of your community after the changes constitutes acceptance.

13. Data Processing Addendum (DPA)

This Addendum applies when, within your community, you act as controller of your members' personal data for your own purposes, and WEMANY acts as processor, processing that data according to your instructions.

13.1 Subject matter and duration

WEMANY processes your community members' data to provide you the Service, while your account is active or as required by law.

13.2 Instructions

WEMANY processes the data only in accordance with these Terms and your documented instructions, except where legally required.

13.3 Confidentiality

WEMANY's authorized personnel are bound by confidentiality duties.

13.4 Security

WEMANY applies appropriate technical and organizational measures (encryption, access controls, audit logs).

13.5 Sub-processors

You authorize WEMANY to use sub-processors (for example, Amazon Web Services cloud infrastructure and payment processors), contractually bound to an equivalent level of protection. WEMANY will inform you of relevant sub-processor changes and is accountable for their performance.

13.6 Data subject rights

WEMANY will reasonably assist you in handling members' requests (access, rectification, erasure, portability, objection).

13.7 Incidents

WEMANY will notify you without undue delay of any security breach affecting your community's data, so you can meet your notification obligations.

13.8 Return or deletion

Upon termination, WEMANY will delete or return the personal data to you, as you choose, except for retention required by law.

13.9 International transfers

Data is hosted in the United States (Amazon Web Services). For transfers from the EU/EEA/UK, Standard Contractual Clauses or other valid mechanisms apply.

13.10 Creator's responsibility

As controller, you warrant that you have the legal basis and necessary consents for the data you process, and you are responsible to your members and to the authorities for your own processing decisions.
