Privacy Policy

1. Introduction

Wemany Inc. ("WEMANY", "we") respects your privacy and is committed to protecting your personal information. This Policy explains how we collect, use, share and protect your information when you use our digital community platform and related services (the "Service").

2. Controller and processor

WEMANY plays two distinct roles depending on the data:

  • WEMANY as controller: with respect to the data we process to operate the platform and for our own purposes — account creation and management, authentication, payments, the WeMatch system, the Mission Score, the public reputation profile, security, communications and improvement of the Service.
  • WEMANY as processor: with respect to the data a community creator decides to process within their community for their own purposes (for example, their member list or gamification settings). In those cases the creator is the controller and WEMANY processes the data following their instructions, in accordance with the Data Processing Addendum included in the Community Creator Terms.

This distinction defines who is accountable for each processing activity and to whom you should address your requests.

3. Information we collect

3.1 Information you give us directly

  • Account: name, username, email, phone, profile photo.
  • Community content: posts, comments, messages, files, descriptions.
  • Payment information: billing address and payment method (processed securely by our processors; we do not store your full card details).
  • Communications: messages you send us, feedback and support requests.
  • Connected accounts: information from external accounts you choose to connect for WeMatch (see the WeMatch Policy).
  • Purchase data (buyers without a prior account): when you make a purchase without having registered first, we collect your email, name, billing details and the information needed to process the payment. This data is used to automatically create your account and deliver the product or service you purchased.

3.2 Information we collect automatically

  • Usage: pages visited, features used, time and interactions.
  • Device: IP address, browser and device type, operating system, identifiers.
  • Location: general geographic location by IP (precise location only with your consent).
  • Cookies and similar technologies: see the Cookie Policy.

3.3 Mobile app information

When you use our mobile app, we may collect:

  • Device identifiers: unique device ID, advertising ID (IDFA/GAID), model, manufacturer and operating system version.
  • Push notification tokens: technical identifiers needed to send notifications to your device.
  • Permission data: information about which permissions you have granted the app (camera, microphone, location, notifications).
  • App usage data: features used, session time, interactions, errors and performance.
  • Media content: photos, videos and audio you capture or upload through the app (when you use the camera or microphone for lives, posts or messages).

3.4 Live streams (Lives)

When you take part in live streams:

  • As a streamer: we collect the video and audio content you stream, stream metadata (date, time, duration, participants) and audience metrics.
  • As a viewer: we collect your participation (comments, reactions) and viewing data.
  • Recordings: streams may be recorded and stored according to the community creator's settings. The creator is responsible for informing participants if the stream will be recorded.
  • Retention: live stream recordings are kept for a maximum of 30 days on WEMANY's servers, after which they are automatically deleted. The community creator can download the recording during that period if they wish to keep it. Once deleted from our servers, WEMANY keeps no copies.

3.5 Push notifications

We send push notifications to your mobile device for:

  • Transactional notifications: payment confirmations, content access, security alerts, changes to your account. These are necessary for the Service to work.
  • Activity notifications: new messages, comments, mentions, activity in your communities, live streams starting.
  • Promotional notifications: news, special events, community recommendations (only with your consent).

Managing notifications: you can configure which types of notifications you receive from the app settings and from your device settings (iOS/Android). Turning off push notifications does not affect email communications, which are managed separately.

3.6 Third-party information

  • Data from connected accounts and from payment and analytics providers.
  • Public information that helps verify your identity or improve the Service.

4. How we use your information

  • Providing the Service: operating and improving the platform.
  • Account management: creating and managing your account, authenticating you and giving you support.
  • Community features: communities, participation, content and gamification.
  • WeMatch and Mission Score: validating achievements and calculating your score (see the WeMatch Policy).
  • Payments: processing subscriptions and transactions.
  • Communications: service notices, security alerts and, with your consent, promotional material.
  • Security: detecting fraud, preventing abuse and monitoring violations of the Terms.
  • Legal compliance: meeting legal obligations and valid requests from authorities.
  • Push notifications: sending you activity alerts, messages, live events and relevant Service communications.
  • Live streams: facilitating the transmission and reception of real-time video and audio content, and providing metrics to creators.

Legal bases (GDPR): performance of the contract (providing the Service, payments, transactional notifications and app features), consent (connected accounts, marketing, precise location, promotional notifications, camera/microphone access), legitimate interest (security, service improvement, activity notifications) and legal obligation.

Account creation at purchase: the legal basis for creating your account at the time of purchase is performance of the contract — we need to create your account to deliver the content or service you purchased. To send you communications about your account and your purchase, we rely on the legitimate interest of providing the service and keeping you informed about your access. The processing is proportionate: we only create the account with the minimum necessary data and give you control to activate, modify or delete it.

5. How we share your information

  • With your consent: information you choose to make public or share.
  • Service providers: cloud infrastructure (data is hosted on Amazon Web Services), payment processors, analytics (anonymized where possible), support and security. They act as processors, only process according to our instructions and under confidentiality.
  • Community creators: aggregated, non-identifiable analytics of their community; basic participation metrics; relevant validation data when you consent to it (subject to your privacy settings).
  • Legal requirements: under a valid order or to protect rights, safety or integrity.
  • Business transfers: in the event of a merger, acquisition or sale of assets, with notice as required by law.

We do not sell your personal information.

6. Retention

  • Account data: while your account is active or as needed to provide the Service.
  • Community content: according to each community's policies, within our general limits.
  • WeMatch data: according to the periods in the WeMatch Policy (raw data: maximum 90 days on a rolling window; validation result: while the badge is visible).
  • Transaction data: for the period required by law.
  • Aggregated/anonymous analytics: may be kept to improve the Service.

7. Your rights

All users

  • Access, rectification, deletion and portability of your data, within the applicable legal and operational limits.

EU/EEA/UK residents (GDPR)

  • Withdraw consent, object to processing based on legitimate interest, request restriction and lodge a complaint with your supervisory authority.

US residents (CCPA/CPRA and similar)

  • Know, delete, correct, opt out of sale/sharing for targeted advertising, and not be discriminated against for exercising your rights.

Colombia residents (Law 1581 of 2012 — Habeas Data)

  • Know, update, rectify and delete your data, revoke authorization and file inquiries and complaints.

To exercise your rights, write to privacy@wemany.com. We will respond within the legal deadlines. If the request concerns data processed by a creator as controller, we will guide you to address it to the creator and assist them as processor.

8. International transfers

WEMANY operates from the United States and your information may be transferred, stored and processed there (Amazon Web Services) and in other countries. For transfers from the EU/EEA/UK we apply appropriate safeguards, such as the Standard Contractual Clauses approved by the European Commission, in addition to other mechanisms permitted by law.

9. Children's privacy

The Service is not directed at children under 13 and we do not knowingly collect data from children under 13. If we become aware of it, we will delete that information.

Users under 18 (or under 16 under local law) may not connect external accounts, use WeMatch, have a Mission Score based on external data, or have a public reputation profile. For users aged 13 to 17 we encourage parental involvement and may require guardian consent for certain features. These measures address COPPA (USA) and equivalent rules.

10. Security

We apply reasonable measures: encryption in transit and at rest, access controls and authentication, periodic assessments and staff training. No system is completely secure, so we cannot guarantee absolute security. In the event of a security breach affecting your data, we will notify the authorities and you within the deadlines and circumstances required by law.

11. Cookies and similar technologies

We use cookies and similar technologies to remember preferences, analyze usage, personalize content and measure communications. See our Cookie Policy and manage your preferences from the consent manager and your browser settings.

12. Third-party services

The Service may link to or integrate with third-party services. This Policy does not cover those services; review their own privacy policies.

13. Changes to this Policy

We may update this Policy. We will notify significant changes by publishing the updated version and, for material changes, by email or another notice as required by law. Continued use after it takes effect constitutes acceptance.
